    Terms and Conditions

Hi! Welcome to theBookmark.ie. We’ve worked hard to make these Terms and Conditions clear and straightforward, so you know exactly what to expect when using our website (www.thebookmark.ie) (www.thebookmark.ie). These terms apply to everyone visiting our site, whether you register with us or just browse. By using our website, you agree to these terms. If you don’t agree, please don’t use the site. We may update these terms from time to time, so check back occasionally for the latest version.

    1. About These Terms
These terms cover your use of our website and any emails you exchange with us. You can browse most of the site without registering, but some areas require you to sign up. We might also have specific terms on certain pages that add to or replace parts of these terms.

    2. Using Our Content
We’re happy for you to browse our website and use it to explore or buy our services. Here’s what you need to know:
    • Our content is protected. Everything on the site (like text, photos, and graphics) is owned by us or our partners and protected by Irish and international copyright laws.
    • Limited use. You can view the website and use it to make purchases. However, you can’t copy, share, modify, or use our content for any other purpose (like selling or distributing it) without our written permission.
    • Breaking the rules. If you misuse our content or break these terms, your right to use the website ends, and you must delete or destroy any copies you’ve made of our materials.

    3. Website Availability
We do our best to keep the website up and running 24/7, but we can’t guarantee it will always be available. Sometimes, we might need to pause access for maintenance, repairs, or other reasons. If the site’s down, we’re not responsible for any inconvenience caused.

    4. Your Contributions
If you post or send anything to our website (like comments or files), here’s what applies:
    • Non-private content. Anything you share (except personal details covered by our Privacy Statement) is considered non-confidential and not owned by you. We can use, copy, or share it for any purpose, commercial or otherwise, without owing you anything.
    • Keep it appropriate. You must not post or send anything that’s:
      • Threatening, offensive, defamatory, obscene, or likely to cause harm or upset.
      • Used for commercial purposes like marketing or spam.
      • Illegal, infringing on someone else’s rights, or harmful to the website (e.g., viruses or malicious software).
      • Collecting others’ personal info (like emails) without their permission.
    • No misuse. Don’t try to hack or harm the website or its users.
    • Our responsibility. We’ll cooperate with law enforcement if they ask us to identify anyone breaking these rules.

    5. Links to Other Websites
Our website might include links to other sites for your convenience. These links don’t mean we endorse those sites. We don’t control or check their content, so you use them at your own risk.

    6. Accuracy of Information
We try to keep the information on our website accurate and up to date, but we can’t promise it’s always perfect. We might change content, products, or prices without notice, and some info might become outdated. Everything on the site is provided “as is,” without any guarantees about its accuracy or suitability for your needs.

    7. Our Liability
We’re not responsible for any issues, losses, or damages you might face from using our website, including:
    • Problems caused by your inability to access the site.
    • Losses from viruses or other issues affecting your devices, software, or data.
    • Any issues from using linked third-party websites.
However, we can’t exclude our liability for:
    • Death or personal injury caused by our negligence.
    • Fraud or deliberate misrepresentation by us.
    • Anything else Irish law doesn’t allow us to exclude.
If using our site causes issues with your equipment or data, you’re responsible for any repair costs.

    8. Returns Policy
We want you to be happy with your purchase! Here’s how our returns process works:
    • Returns for any reason. You can return items within 15 days of purchase for any reason, as long as the item is in perfect, resalable condition (unused, undamaged, and in its original packaging).
    • How to return. Items should be returned:
      • In perfect, resalable condition with all components, parts, and original packaging.
      • Securely wrapped with our delivery slip included.
      • At your cost and risk (you cover shipping unless we agree otherwise).
    • Faulty items. If an item is defective, please let us know within 15 days of purchase. Include a note with the item explaining the fault and when it occurred.
    • Manufacturer’s guarantee. Most items come with a 12-month manufacturer’s warranty. Check the plug, fuse, batteries, and instructions first.
    • Your rights. If you’re in Ireland, you’re protected by the Sale of Goods and Supply of Services Act 1980.
    • What we’ll do. For approved returns (whether for faulty items or other reasons):
      • We’ll refund the cost of the item.
      • For faulty items, we may also refund return shipping costs or offer to repair or replace the item (our choice).
    • Waste equipment. If you buy a similar replacement product from us, we’ll take back your old electronic or electrical item for free, as required by law. You must return it within 15 days of your new purchase, and you cover the shipping cost.

    9. Refunds
If you’re eligible for a refund (e.g., for a faulty item or a cancelled order), we’ll process it using your original payment method within 7 days of receiving the returned item or your cancellation request.

    10. Governing Law
These terms are governed by Irish law. Any disputes will be handled exclusively by Irish courts.
